A former Virginia State Police captain will not serve jail time for the molestation of his former step-daughter.

On Tuesday morning, Edward Hope stood stoically before a Brunswick County judge and pleaded guilty to one felony count of aggravated sexual battery against a child under the under of 13.

The guilty plea was a part of a plea agreement with the Commonwealth of Virginia.

The judge sentenced Hope to 20 years in the state penitentiary, but suspended the entire sentence. Instead, Hope will be on supervised probation for two years and be forced to register as a sex offender.

Proof that if you are a Cop, DA, Judge in VA and you commit a SEx Crime you will get off very easy…

Shame Fills the People's House

(DURHAM)- As expected, the North Carolina Senate voted yesterday to repeal the historic Racial Justice Act. The Act was passed only two years ago to begin the difficult task of eliminating race discrimination from N.C.'s criminal justice system.  The Racial Justice Act Repeal Bill now sits on the Governor's desk. The North Carolina NAACP and its 110+ partners in the Historic Thousands on Jones Street (HKonJ) People's Assembly are hopeful she will veto the Repeal the RJA Bill.  We believe the Racial Justice Act she signed and celebrated two years ago should be given a chance to begin its work.

The Conference of 44 Elected District Attorneys provided the impetus to destroy the RJA. First they wrote a letter "on behalf of 44 District Attorneys" (actually only 42, since the two Black D.A.'s distanced themselves from the Repeal the RJA agenda) that contained wild distortions of the truth. Yesterday they organized victims of horrendous murders to come to the Senate microphone to repeat the horror they had suffered.  Many of us in the NAACP could tell similar stories, and other victims' families spoke in favor of the RJA yesterday, as they have in the past.  This has nothing to do with the ethical duty of the District Attorneys to be "ministers of justice" and to uphold the Constitution, which bans race discrimination in State actions.

A Strange Spirit:

Legislative Racism, Classism and Regression Rather Than an Agenda of Legislative Progress and Prosperity for All North Carolinians

Statement by Rev. Dr. William J. Barber, II President, North Carolina NAACP

The General Assembly is required by law to follow the North Carolina Constitution which states in Article 1, Section 2 "all political power is vested in and derived from the people...and is instituted solely for the good of the whole." They should be upholding Article 1, Section 19 of the North Carolina Constitution, which ensures "no person shall be denied equal protection of the laws; nor shall any person be subjected to discrimination by the State because of race,color,religion, or national origin." The Constitution calls us to a higher place where a "divide and conquer" strategy has no place.

Despite the noble call of our Constitution there is a strange spirit in the halls of the North Carolina General Assembly. The NC General Assembly reconvened last night with two major agenda items: to repeal the Racial Justice Act and pass a Voter Photo ID law that,if accomplished, would have a disparate impact on African Americans,the elderly and other minorities.

These efforts point to an extremist agenda that can be called nothing less than Legislative Racism, Classism and Regression rather than an agenda of Legislative Progress and Prosperity for all North Carolinians.

To be clear, racism and classism are not only overt actions or even the personal feelings and intentions among individual legislators. But to place into public policy an agenda that you know will have a deep and disparate impact on minorities and the poor is Legislative Racism, Classism and Regression.

It is Legislative Racism, Classism and Regression when a southern Legislature chooses to fight against the Racial Justice Act, which gives the courts an opportunity to review more information to ensure race is not a factor in anyone's death sentence. We know from our bloody history that the only place where people are not concerned whether someone is being executed because of their race is the lynching tree. At the lynching tree, the mob doesn't want to know more information about the circumstances of the defendant's trial and crime. The lynch mob only wants to see someone swing.

It is Legislative Racism, Classism and Regression when a state wants fewer people to vote. A voter photo ID requirement could impact close to a million North Carolinians. Twelve percent of African American voters lack an ID, while only 6.7% of white voters lack an ID. African American voters make up 27% of the 555,000 North Carolina voters who have no ID at all. Nearly a third of our elderly, to whom we owe so much do not have an ID. Many of them can remember a time when people died so that African Americans and other minorities could vote.

It is Legislative Racism when our General Assembly uses high-paid, out-of-state consultants to create redistricting maps that pick apart black communities block-by-block,person-by-person to ensure their political prosperity at the expense of the power of the African American vote.

It is Legislative Regression and Racism when the General Assembly passes a budget making the largest cuts to education in the history of our state. $1.25 billion has been cut. We are now sadly 49 th in the nation for per pupil spending. The cuts will have a disparate impact on African Americans and other minorities who depend on public education as the primary way out of the indignity of poverty.

It is Legislative Regression when the General Assembly attempts to codify discrimination into the very heart and framework of our Constitution. Without any public comment,they placed a constitutional amendment on the ballot that is a direct attack on our LGBT sisters and brothers and their families, and set the stage for the first constitutional amendment in the history of North Carolina that would narrow protections rather than expand protections to all persons, and to remedy past injustices.

It is Legislative Racism and Classism when a General Assembly passes a budget that violates the constitutional rights of poor and minority four-year-old children in North Carolina. Our General Assembly severely cut pre-kindergarten programs this year--143 years after Blacks and Whites came together in Raleigh to create a constitution guaranteeing a sound, basic, public education for all North Carolinians.

It is Legislative Classism and Regression when the General Assembly tries to withhold federal unemployment benefits to over 45,000 North Carolinians, money that they had no right to deny from hard working families.

It is Legislative Racism, Classism and Regression when the General Assembly passes a budget that cuts 15.5% from the University of North Carolina system, which will have a devastating impact on minority, poor, and first generation college students. Across the UNC system, and in particular at HBCU's and other under-financed institutions, students are already desperately trying to figure out how to stay in school--if they haven't dropped out already.

It is Legislative Racism and Classism when the General Assembly slashes funding to the Indigent Defense Services and underpays public defenders, who are often the only hope for young black men and women to escape an often unequal and unfair criminal justice system.

What is tragic about the Racist, Classist and Regressive Legislative Agenda of the current leadership in the General Assembly is that, amidst their attempts to take us backwards,they ignore the crisis of unemployment and poverty in North Carolina, and in particular in the African American and Latino communities who have been in crisis long before the current recession hit other segments of the community.

We will not be discouraged, but will push forward. We will continue to fight until we study Regression,Classism and Racism no more.

The Friendly Atheist tells the story of A Christian bookstore who denied a patron's request to print the above Bible verse on their t-shirts. (how Christian of them)

They had a t-shirt printer that was used to put verses. I asked if a printing of a Timothy 2:12 shirt was reasonable. Being Christians, they had never looked that far into the Bible, so they looked it up with their handy dandy on site Bible. When they recited the verse (A woman happened to be the reader of the Bible) they informed me of how disrespectful of their religion I was being. I was unsure of how I was being disrespectful by asking for a verse from their Holy Book.

This week Message from Richard Burr

On Tuesday, I returned from a short trip to Afghanistan where I was fulfilling my role as a member of the Senate Select Committee on Intelligence to meet with officials on the ground and learn firsthand about the progress being made there.  I had the opportunity to meet with senior Afghan and U.S. officials who provided us with updates on the security situation in the region.

While I was in Afghanistan, I received word about the inability of the super committee to reach a deal to reduce our debt.  I share the disappointment expressed by members of the committee, but given the lack of leadership from the President and deep divisions between the members of the committee and many in both the House and Senate, I cannot say that I am shocked by this outcome.  The American people will now have to choose for themselves next November which approach they believe is the right path to take to address our nation’s future: continued overspending supported by tax increases and more borrowing, or a hard look at Washington’s spending habits and reforms to our nation’s tax code and entitlement programs.

This week, Americans across the country will gather together with friends and family to celebrate Thanksgiving and reflect on all that we have to be thankful for - both individually and as a nation. Traveling to Afghanistan and visiting with our servicemembers as well as Afghan citizens makes this holiday even more significant.  We live in a country where we can openly express our opinions and practice our religion freely.  We wake up in the morning knowing that there are men and women halfway across the world who are fighting, and some who are dying, for these rights and for our safety.

America has risen to great heights since the celebration of the first Thanksgiving, but there are still many Americans who find themselves in need during this holiday season.  Let us keep them in our thoughts and focus on what we can do to help those less fortunate than we are.  We also remember the volunteers who help serve the homeless and others in need.  They exemplify American generosity, and we thank them for their goodwill.

For many North Carolina families, a parent, brother, sister, or child will be away this Thanksgiving serving in the Armed Services.  Let’s all take a few minutes to thank our nation’s service members and military families for their patriotism and sacrifice. Our thoughts and prayers go out to all those serving overseas and to families who have lost a loved one or who may be caring for an injured veteran.

NC: A first: Baptist Church Votes "No Marriages Until Gays Can Marry Too"

The congregants said in a formal statement that current North Carolina law - and the language proposed for a vote next year on an amendment to the state Constitution - discriminates against same-sex couples "by denying them the rights and privileges enjoyed by heterosexual married couples." "As people of faith, affirming the Christian teaching that before God all people are equal, we will no longer participate in this discrimination," the church's statement says. The vote was unanimous and brought tears to the eyes of some of the 100 or so members who stood to vote in favor of the "statement on marriage ceremonies."

Two police officers involved in a pepper-spraying incident at the University of California-Davis have been placed on leave, and over the weekend, the university’s faculty association called for the chancellor’s resignation. But Chancellor Linda Katehi told ABC’s Good Morning America on Monday that she’s staying put. “I really feel confident at this point the university needs me,” she told GMA. “There are so many critical issues to be addressed and we really need to start the healing process and move forward.”

I thinks she does, you give an order, praise the officers then throw them under the bus.. This Woman isn’t fit for the job that she holds.. She need to go ASAP..

Katehi at first spoke in support of the police, whom she had ordered to take down the UC Davis Occupy encampment, saying they had no other option. But she later called the footage 'chilling'.

Los Angeles attorney Okorie Okorocha said the use of the chemical spray was overly forceful and illogical.

'Tear gas you spray in the area you want people to move away from,' Okorocha told ABC News. 'Pepper spray is to keep the people from being able to mount an attack. Here the police officer is trying to disperse a crowd. Why would you incapacitate them?'

So let’s be clear what the proposed amendment the Legislature in North Carolina just passed and placed on the ballot does— it does not just define marriage as only between a man and a woman—it also bars all heterosexual as well as gay domestic partnerships and civil unions.

This is not a mere codification of the existing law, but a vast expansion, creating one of the most, if not the most, extreme and intrusive law in the nation—setting NC on an 8 month course for a bitter, divisive campaign pitting North Carolinian against North Carolinian; family members against each other, and serving only to create an atmosphere of tension, instability and the almost certain potential for acts of prejudice across this state on all fronts—at a time when North Carolina needed leadership and unity, our citizens found little of either in the General Assembly.

And what was the exigency for this crucial amendment, requiring a special session  of the legislature to adopt—since the law of North Carolina has been clean and clear for decades—that marriage is only recognized in this state between man and woman-was there a bill pending to change that law?  No.  Ever been one? No.  A lawsuit in State or Federal court to challenge the North Carolina law? Nope.

Overwhelming public support or polling data indicating this issue was top of mind and worry for North Carolinians? Nope—jobs and education and health care and practically
every other topic was ahead of this Kafkaesque proposal.

The sad genesis of this amendment— only the second one ever proposed to eliminate
minority rights rather than expand them—was quite simply fear.  The North Carolina Legislature seeks a public vote to amend our constitution out of nothing but fear—fear of aberrant judge; fear of the unknown to some; fear of  fellow citizens who just might find the search for liberty encompasses different principles in different generations.

As Justice Kennedy has written, “liberty presumes an autonomy of self that includes freedom of thought, belief, expression and certain intimate conduct”—but apparently not in the NC legislature.

So what is the effect of this proposed amendment?

Gov. Perdue Issues Disaster Declaration for Davidson and Randolph Counties - Press Release: Gov. Bev Perdue

Aid Made Available for Homeowners and Businesses

Gov. Bev Perdue today issued a disaster declaration for Davidson and Randolph counties following the severe weather and tornadoes that struck on the evening of Nov. 16.

"I will make sure that any possible aid is provided to those who suffered damages from the tornadoes and other severe weather," Gov. Perdue said. "It is critical that we help get our fellow North Carolinians back in their homes and their businesses back to normal as soon as possible."

The declaration allows the Governor to make available individual assistance for victims of the storms, typically in the form of grants for housing and other essential needs, up to a maximum of $30,400.  State officials will be opening a disaster recovery center in the coming days where storm victims can apply for assistance.

Gov. Perdue dispatched a letter Friday asking for assistance from the U.S. Small Business Administration. That federal agency can provide low interest loans for homeowners, renters and businesses that suffered damage from the storms.

The storms that rolled across the state that evening caused two fatalities and damaged dozens of homes in the two counties. Davidson County declared a local state of emergency that evening, and Randolph County did the same the following day. On Nov. 18, damage assessment teams from the North Carolina Division of Emergency Management and the SBA assisted local officials in both counties in determining the extent of the damage. Those assessments did not meet the threshold for a presidential disaster declaration, but Gov. Perdue proceeded with a state declaration and is awaiting action by the SBA.

LGBT Center Chooses New Executive Director

RALEIGH, NC, November 19, 2011 - The Board of Trustees of The LGBT James MillerCenter of Raleigh has announced today they have selected James Miller as the new Executive Director of The LGBT Center of Raleigh.

The LGBT Center, a Community Center that supports the needs of gay, lesbian, bisexual and transgender individuals within the Triangle and beyond, announced in October that it was beginning the search for an Executive Director.

Miller, a native of North Carolina hailing from the coast, returns to the state following working with the Massachusetts Department of Public Health in Boston. Miller recently acquired a Master's in Public Policy and a Master's in Business Administration from Brandeis University. He brings with him of wealth of knowledge in both nonprofit management and the LGBT community.
"The Board of the LGBT Center is excited to welcome James Miller as the new Executive Director," says Board Chair Glen Medders. "James arrives at a time of very rapid growth and expansion of the Center and its programs and services. The keynote panel will begin shortly after 4pm, Saturday afternoon, November 12, in Greensboro at the Elliot University Center on the campus of UNC-Greensboro.

Baptists meeting today in Greensboro elected Charlotte pastor Mark Harris to be their new president and endorsed a proposed state constitutional amendment that would reinforce North Carolina's ban on same-sex marriage. Most of the 4,300 churches associated with the state convention are Southern Baptist - the largest Protestant denomination in North Carolina, with about 1.3 million members.
Harris has pledged to campaign for the amendment.

As of Veterans Day 2011, more than 10,000 people have joined a growing campaign on Change.org demanding Dallas VA Medical Center fire nurse who allegedly subjected honorably discharged lesbian Marine veteran to anti-gay tirade.

DALLAS, TX – More than 10,000 people have joined a popular campaign on Change.org supporting a lesbian veteran’s demand that the Dallas Veterans Affairs Medical Center investigate and fire a nurse who allegedly subjected the veteran to a homophobic rant about her sexual orientation. 

According to a report in the Dallas Voice, former Marine Lance Corporal Esther Garatie, 28, went to the Dallas VA Medical Center on October 12 to “seek treatment for severe depression and possible post-traumatic stress disorder — including thoughts of suicide.” Garatie, who was wounded and honorably discharged from the Marines, claims that nurse practitioner Lincy Pandithurai told her the reason she was depressed and contemplating suicide was because she is a lesbian. 

“She sat down and looked at me, and her first question was, ‘Are you a lesbian?’” Garatie wrote in a personal statement written one day after the incident and published by the Voice. “Her second question to me was, ‘Have you asked God into your heart? Have you been saved by Jesus Christ?’”

“This is when I realized that I was no longer a United States veteran in her eyes,” Garatie continued. “I was just a homosexual.”

Within hours of the hospital visit Esther’s friend Jessica Gerson launched a campaign and recruited hundreds of supporters on Change.org, the world’s fastest growing platform for social change. As of Veterans Day, more than 12,000 people have now signed the online petition campaign.

“I can’t imagine Esther’s feeling very appreciated this Veterans Day,” said Gerson. “Esther was honorably discharged from the military for an injury she incurred while serving her country. How dare Nurse Pandithurai attack her with such bigotry and intolerance? She should be fired from the Dallas VA Medical Center and have her license revoked by the Texas Board of Nursing.”

Garatie has filed official complaints with the VA Medical Center and the Texas Board of Nursing against the nurse practitioner. Monica Smith, a spokeswoman for the VA Medical Center, confirmed to Change.org in an email that the Dallas VA is currently reviewing the complaint and will complete its investigation within the next few weeks. 

“We started a fact-finding review when this allegation was first brought to our attention,” said Smith. “To get a more in-depth look at the allegation, VA North Texas is now conducting an administrative investigation board review and expects to have that completed by the end of November.”

This video is difficult to watch and some viewers may find the footage from Berkeley, California disturbing. In it, a line of police in riot gear attempt to surge into a line of peaceful protesters, jabbing with night-sticks. Cries of pain and alarm are heard as the protesters are jabbed in the gut, punched, and knocked to the ground.

In spite of what is apparently a police effort to scatter them, however, the protesters stand firm. They lock arms and chant “Stop beating students!” in unison and the video ends in a tense standoff.

How much more will the people take before the People go after the Cops at these Rallies,Protests and Occupies????

on behalf of all of our branches

and the 110+ partners in the HKonJ People's Assembly Coalition 

Once again, tonight marks a major step forward on the Highway of Justice and Love. Once again, children of all colors, we pray, can feel welcome in their schools and at their School Board. There are thousands of children today in Wake County whose only hope in escaping poverty is in our public schools. Their only hope is a high quality, constitutional, well-funded, diverse public education. Their only hope is strong schools with high student achievement, which require diversity and resources. Their only hope is a loving teacher, who nurtures the spark in them in the early grades, who spends some moments with them on the playground, expanding their world, igniting their interest in learning, and telling them they are as smart and as good as any other child and they can follow their dreams. Children who, though no one in the family ever went to college, understand that opportunities for higher education are open to them just as they are for those who come from college educated families. Let us welcome all children into our fine public school system.

Once again, Blacks, Whites, Latinos, Asians, Native Americans, old and young, rich and poor, Republicans and Democrats have all said, "We want to go forward and not backwards." It is our great hope that after these elections, the single focus of Wake County School Board is to set an example not only for North Carolina but for the nation that all children deserve a high quality, constitutional, well-funded and diverse public education.

Both tonight and on October 11, 2011, the voices of parents, grandparents, teachers, students and community members rejected candidates who support regressive public policy that leads to resegregation of our public schools. Their commitment speaks clearly to the rest of North Carolina, but also to the national debate over public education reform, which must have diversity and resources at the center. Tonight, we hope, marks a shift in the public policy of the Wake County School Board that will work toward the Gold Standard student assignment plan that builds upon past successes and commitments to diversity that made Wake County schools great, rather than destroy the progress we had made.

If we are able to unify and make a commitment to these principles, our children, our community and our future will be better because of our efforts.

We in the NAACP believe all educational decisions must be guided by the standards of the law with respect to civil rights, the data of sound research, which continually proves that diversity and resources are key components to student achievement, and the lessons of history that remind us we must go forward and not backwards.

We know what works if we want to provide a high quality education for every child. From the beginning, the NAACP has noted eight fundamental principles that must guide any real desire to have healthy schools and strong public education:

  1. Stop resegregation and promote diversity
  2. Provide equity in funding for all schools
  3. Provide high quality teachers and smaller classrooms
  4. Provide high quality leadership teams
  5. Provide high quality facilities
  6. Focus on math, science, reading and history
  7. Support parental and community involvement
  8. Address unjust and disproportionate suspensions, reduce dropout rates and increase graduation rates among African-American students

The NAACP believes that Truth will win out; that healing the breach in God's family is difficult, but the results are worth the struggle and the bad times; and we will win. Tonight we believe the beginning of change in the power configuration of the school board is a small victory for people of goodwill in the battle to keep pushing forward for the common good.

A Message from Senator Richard Burr

It was a pleasure to be in North Carolina last week traveling across the state, visiting with North Carolinians and discussing their concerns and the issues they would like to see us address in Washington, but it was back to business as usual in Congress this week.  Despite the urgency of the issues we are working on in Congress, there was little progress made on behalf of the American people this week.

Even though it is clear that the first stimulus bill did not create the jobs it promised, some in Washington continue to push these failed, expensive policies of the past that stand no chance of passing Congress.  Meanwhile, however, Republicans have been working on legislation that could garner bipartisan support and actually spur the economy.  In fact, the House of Representatives successfully passed 15 bills with bipartisan support, but the Majority Leader in the Senate refuses to bring these “Forgotten 15” jobs bills up for vote.  It is extremely disappointing that these bills are being ignored in the Senate and that job-spurring legislation that could actually be passed into law and turn our economy around is not being brought to the floor for consideration.  

On Tuesday, prior to returning to Washington, I was honored to deliver one of the keynote addresses at the Building a Culture of Innovation through Education event at North Carolina State University.   In order for America’s youth to be prepared for the workforce, we must provide them a quality education.  As technology has progressed and methods of communication have evolved, the ways that children learn and respond to teaching have changed as well.  We must continue to discuss and develop innovative ways to increase achievement in the classroom to ensure that America’s students receive the training, knowledge and preparation they need to succeed in the workforce.  Read more about my address at NCSU here

In addition, I was happy to join Cam Edwards on NRA News on Wednesday afternoon to discuss a bill I introduced to protect the Second Amendment rights of our nation’s veterans and make sure that they are afforded the same due process under the law as all other American citizens.  Since I introduced the bill on October 13, it has received bipartisan support.  The Veterans Second Amendment Protection Act currently has 18 co-sponsors, and I am hopeful that it will pass this Congress.  You may listen to the interview here and read more about the bill here.
